Which renovations require planning permission in Mallorca?

In Mallorca, any renovation that alters the structure, layout, façade, or intended use of a property requires a formal building permit (Licencia de Obra) from your local Ayuntamiento.

While minor cosmetic changes (like interior painting) are generally exempt, the Balearic authorities now use the Agencia de Defensa del Territorio (ADT) uses high-resolution satellite imagery and data comparison tools to detect unauthorised works, to detect any unauthorized external changes, including pools, terraces, and roof modifications, in real-time.

Many owners believe their project is too small to notice. In 2026, this is a dangerous assumption.

What is a building permit in Mallorca?
A building permit (Licencia de Obra) is official approval from the local town hall required before carrying out structural or regulated renovation works.

You NEED a permit if you
remove or add walls
change the internal layout
modify the façade (windows, doors, roof)
build extensions (rooms, porches, pools)
change the use (e.g. garage to bedroom)

You usually DON’T need a permit for
Interior painting & wallpapering
Sanding & varnishing parquet floors
Replacing tiles (same material/style)
Kitchen/Bathroom cabinet updates
Minor electrical/plumbing repairs

Note: Even for "small works," you must often file a Declaración Responsable (Responsible Declaration) to notify the town hall legally.

Understanding the 3 Types of Permits

Licencia de Obra Mayor
(Major Works)
For structural changes, extensions, or new builds. Requires a project signed by an Architect and a technical lead (Aparejador).

Licencia de Obra Menor
(Minor Works or Comunicación Previa)
For non-structural renovations such as window replacement or internal wall redistribution.

Declaración Responsable: A simplified "fast-track" notification for minor repairs. Legally binding and subject to inspection.

The "8-Year Clock"
While a statute of limitations (Prescripción) of 8 years exists for many infractions, it does not apply to protected land (Suelo Protegido), where the authorities can act indefinitely. This does NOT mean the property is fully legal — only that enforcement may be limited.

Apartments & Community Rules (The "Neighbor" Risk)
In apartment complexes (Comunidades), you face double the risk.

Even with a town hall permit, you often need Community Approval for:
Enclosing a balcony (frequently illegal in 2026)
Changing the color or style of windows/shutters.
Moving wet rooms (kitchens/baths) above a neighbor's bedroom

How to Renovate Safely: A 5-Step Strategy

Technical Audit: Have an expert check your property's current legality (Cédula de Habitabilidad check).
Define the Scope: Determine if it’s Obra Mayor or Menor.
Check Local Bylaws: Rules in Calvià differ significantly from Palma or Andratx.
The "Amnesty" Check: If you have existing illegal works, check if the current 2024-2027 Amnesty allows for retrospective legalisation before starting new works
Formal Submission: Never start before the Declaración is filed or the Licencia is granted.

FAQ – Renovation Permits

Can I sell a property with "recent" illegal works?
It is extremely difficult. Banks in 2026 often refuse mortgages if the Cédula is expired due to illegal renovations.

Does the 8-year rule make my renovation legal?
No. It only protects it from demolition. To make it "legal" (and sellable at full value), you still need a formal Legalización process.

How much are the taxes?
Expect to pay around 4% to 6% of the construction budget (PEM) in municipal taxes (ICIO).
